Summary of decision
The SRA has disqualified Mr Brodie from holding any of the following positions in a licensed body with immediate effect:
- Head of Legal Practice
- Head of Finance and Administration
- A manager
- An employee.
The facts of the case
Mr Brodie was a non-authorised individual and a Probate and Trust Manager at Meridian Private Client Solicitors Limited. On 28 January 2021, at Wolverhampton Crown Court, he pleaded guilty and was convicted of the following offences:
- Person 18 or over attempt to cause/incite a girl aged 13-15 years to engage in sexual activity-no penetration.
- Make indecent photograph/pseudo photograph of a child.
On 25 February 2021 Mr Brodie was sentenced as follows:
- 22 months imprisonment suspended for 24 months.
- 55 days of rehabilitation activity.
- Forfeiture and destruction of all electrical items.
- He would be subject to a sexual harm prevention order for a period of 10 years.
- He would be on the sex offender register for period of 10 years.
Our decision on sanction
Mr Brodie's conduct breached relevant duties that applied to him as an employee of the firm, namely, Principle 2 of the SRA Principles 2019.
It was found that it would be undesirable for Mr Brodie to act as a Head of Legal Practice, Head of Finance and Administration, a manager or an employee of a body licensed in accordance with section 99 of the Legal Services Act 2007.
Mr Brodie was disqualified from holding any of these roles.
He was also directed to pay costs of £600.
