MCS Solicitors Ltd (SRA number 819841) (the firm) has been granted permission under Section 43 of the solicitors Act 1974 to employ Mukesh Sahan (SRA number 7021126) as a 'Caseworker' subject to the following conditions:
- Mukesh Salhan's work is at all times supervised by Hockam Salhan (SRA number 142676).
- If Hockam Salhan is absent from the office for more than 24 hours then Mukesh Salhan cannot attend the office.
- Mukesh Salhan's employment at the firm is limited to that as outlined by them in their initial application dated 13 August 2025 and the following documents:
- Supplied job description and personal specifications;
- Supervisors and Supervision extract from the firm's 'Quality Procedures Manual';
- Letter from Hockam Salhan, dated 13 August 2025.
This is with the exception of the amendments agreed by Hockam Salhan's in his email, dated 11 September 2025.
- Mukesh Salhan's supervision is as per the details provided to us by the firm in their initial application dated 13 August 2025 and the following documents:
- Supplied job description and personal specifications;
- Supervisors and Supervision extract from the firm's 'Quality Procedures Manual';
- Letter from Hockam Salhan, dated 13 August 2025.
This is with the exception of the amendments agreed by Hockam Salhan's in his email, dated 11 September 2025.
- Mukesh Salhan is not responsible for the supervision of other staff.
- Mukesh Salhan does not have access to any office or client account and is not a signatory to any office or client account.
- Any proposed variation to Mukesh Salhan's duties, or arrangements as to his supervision are notified to us in advance of the change taking place and that the variation must not take place until permission is granted by us.
- This approval will lapse if Mukesh Salhan's employment with the firm is terminated or if Mukesh Salhan leaves the firm.
- This approval and the conditions attached to it are subject to review at the absolute discretion of the SRA.
Reasons/basis
Mukesh Salhan was made subject to an order under section 43 of the Solicitors Act 1974 on 23 July 2025. In accordance with section 43 of the Solicitors Act 1974, any solicitor wishing to employ or remunerate him in connection with their practise as a solicitor must obtain our approval.
The SRA is satisfied that the above employment will not put public confidence in the administration of justice and the provision of legal services or the interests of clients at risk.

Summary of decision
The SRA has put restrictions on where and how Mr Salhan can work in an SRA regulated firm.
It was found that Mr Salhan, who is not a solicitor, was involved in a legal practice and has been convicted of criminal offences which are such that it is undesirable for him to be involved in a legal practice in any of the ways described in the order below.
The facts of the case
Mr Salhan is a non-authorised person. At the time of his criminal convictions he was employed as a trainee solicitor at MCS Solicitors Limited, a recognised body. Mr Salhan is currently still employed by that firm.
On 20 January 2025 at Dudley Magistrates' Court, Mr Salhan was convicted of common assault and racially aggravated public order, contrary to section 39 of the Criminal Justice Act 1988 and section 28 of the Crime and Disorder Act 1988 respectively.
Decision on outcome
An order pursuant to section 43(2) of the Solicitors Act 1974 was imposed as Mr Salhan' conduct meant that it was undesirable for him to be involved in a legal practice without the SRA's prior approval. The order, pursuant to section 43, was made to take effect 28 days from the date of the letter or email notifying Mr Salhan of this decision:
Mr Salhan was also ordered to pay the SRA's costs of £1,350.
What our Section 43 order means
- no solicitor shall employ or remunerate him in connection with his/her practice as a solicitor;
- no employee of a solicitor shall employ or remunerate him in connection with the solicitor's practice;
- no recognised body shall employ or remunerate him;
- no manager or employee of a recognised body shall employ or remunerate him in connection with the business of that body;
- no recognised body or manager or employee of such a body shall permit him to be a manager of the body; and
- no recognised body or manager or employee of such a body shall permit him to have an interest in the body
except in accordance with the SRA's prior written permission.
